Madras HC Dismisses Case Against Rajinikanth

The Madras High Court recently dismissed a case against Rajinikanth. The complainant in the case, Mukunchand Bothra had alleged that a loan amount of Rs 65 lakhs was borrowed by Kasthuri Raja with the assurance that Rajinikanth would pay it back, if Raja fails to do so.

The judge presiding over the case penalised Bothra for the suit and has asked him to pay Rs 25,000 to Rajinikanth.

“If such plaints are not thrown out at the initial stage, it will give a licence to people like the plaintiff to approach the court often, even to get cheap publicity,” Justice Sathish Kumar observed.

“It is common knowledge that any litigation filed against any person who is in the limelight and a public personality will get huge attraction in the media and it will be a hot news for a few days. The plaintiff filed such a suit in order to get publicity and not for any other purpose,” the judge added.

Bothra had also asked the court to direct Rajinikanth to take action against Raja for misusing his name.

“Taking action for misusing names is the choice of the person whose name has been allegedly misused.” The court cannot compel the person to take action, the judge said. Moreover, such an action is barred under the Section 39 of the Special Relief Act.

A spokesperson for Rajinikanth confirmed that there are no plans to take action against Kasthuri Raja at present. “The victory in this case is a definite win and an example for any and all financiers and finance-related personnel who are ready to take dubious sureties in order to further the level of their influence. There are many more such people out there, who are unscrupulous in their work. Innocents are caught in the middle of this,” he said.

A spokesperson for Kasthuri Raja and Dhanush chose not to comment on the issue.
